Terms
Updated October 14, 2026
1. About these terms
These terms are an agreement between you and Lucero Studio, Morlans, San Sebastián, Spain, who runs Calmquit ("we", "us"). They apply to the Calmquit apps for iPhone, iPad and Android and to the website at https://calmquit.com, together "Calmquit". Calmquit has no web app: the website tells you about the apps.
By creating an account or using Calmquit, you accept these terms. If you do not accept them, do not use Calmquit.
Calmquit is about your health, so please read sections 3 to 6 in full. They say what Calmquit is not, and what to do in an emergency.
2. What Calmquit does
Calmquit helps you stop using nicotine: cigarettes, vapes and nicotine pouches. It is education and self-help:
- A course of short lessons that explain how nicotine keeps its hold.
- A quit day you choose.
- A toolkit for after: the craving screen, which stays with you through an urge; daily check-ins; a journal of your check-ins, cravings and slips; and your progress, such as your time free, the money you kept, your milestones and what usually happens in the body after stopping.
- Noa, an AI coach you can write to (section 5).
Your quit plan and progress are kept with your account (section 8). Noa's replies are written by AI models that other companies run for us. We cannot promise that a reply is correct, complete or right for you.
3. What Calmquit is not
- Not a medical treatment. Calmquit is education and self-help. It does not treat nicotine dependence or any other disease or condition, and no health professional runs it or reads what you write.
- Not medical advice, a diagnosis or a prescription. Calmquit gives general information about stopping nicotine. It does not tell you which medicine to take, and it does not prescribe, adjust or stop a medicine or a treatment. Questions about medicines, nicotine replacement and other quit medicines included, go to a pharmacist or a doctor, as Calmquit's note on medication says.
- Not a medical device. Calmquit is not meant to diagnose, treat, cure, monitor or prevent any disease or condition.
- No promise that you will stop. We cannot promise that you will stop, or stay stopped, and we publish no figures about how many people do.
- General facts, not a measurement of you. What Calmquit shows about the body after stopping is general information, each fact beside its source. It does not measure your body. Your counters, such as the money you kept, are worked out from what you enter.
- Not therapy or a mental health service. Calmquit can help with the stress and low moods that come with stopping, but it is not therapy, counselling or psychological care.
- Not an emergency service. See section 4.
4. Emergencies
Calmquit is not for emergencies. If you or someone else may be in danger, call your local emergency number now. Do not wait for a reply, and do not use Calmquit instead of calling.
When a message to Noa describes what may be a medical emergency, or a crisis such as thoughts of suicide or self-harm, Noa is told to give the emergency number and, where we have one, a crisis line for the country in your quit plan, and to urge you to call them. But Noa can miss an emergency, a number can change, and Noa may be unavailable when you need it. Once you reach the day's message limit (section 5), Noa does not answer until the next day, even in an emergency, and the app only tells you that you have reached the limit. Get help, in Profile, does not depend on Noa: it lists the numbers we have for the country in your quit plan whenever you open it. We cannot promise that Noa will give a number, or that a number is right where you are. Nobody at Lucero Studio watches chats or can send help.
5. Noa is an AI
- Noa is an AI coach: software, not a person. It is not a doctor, a counsellor or another professional, and it has not quit anything itself. It has no qualifications, licence or life story, and Calmquit shows "AI" beside its name. If you ask, it says plainly that it is an AI.
- It can sound warm and personal, and it reads your quit plan and progress to answer you (section 8). It is still software: it can be wrong, sound surer than it should, or miss something important.
- Noa does not give doses. For medicines, follow the package leaflet and ask a pharmacist or a doctor.
- Noa reads text only: you cannot send it photos or documents.
- You can send Noa up to 100 messages a day. The limit starts over each day in your time zone. The app shows you when you reach it, and Noa answers again the next day.
6. Your health decisions
Decisions about your health are yours. Use Calmquit to understand nicotine and to prepare, not to decide on your own about your health:
- Check with a doctor, a pharmacist or another qualified professional before you start, stop or change a medicine, nicotine replacement included, or decide not to get care.
- If you are pregnant, or have a health condition, talk to a doctor or a pharmacist about stopping as well.
- If you feel unwell after stopping, or something worries you, get care. Do not wait for Calmquit.
- Medicines: Calmquit does not give doses. Follow the package leaflet and ask a pharmacist or a doctor.
7. Privacy
Our privacy policy explains what we collect, why, who helps us run Calmquit, and what you can do about your data. It is part of these terms.
8. Your quit plan and progress
- What you enter is kept with your account: what you use and how much, what it costs, your quit day, your reasons, your answers to the lessons' questions, your check-ins, the cravings and slips you log, and your messages to Noa. We keep it on our servers to show you your plan and progress on your device, and so that Noa can use it to answer you. We never sell it or use it for ads.
- Your consent: before Calmquit keeps your quit plan, it asks for your consent, with the I agree box under Your data. The answers you give before you sign in stay on your device until you save your plan. If we change what we keep, Calmquit asks you again. To withdraw your consent, delete your account (see the account deletion page) or write to us.
- Check what you enter. Your counters and Noa's replies are only as right as what you enter. You can change your plan in Profile, under Your quit plan, and delete a check-in, a craving or a slip from your journal.
- Reminders: the reminders you turn on are set on your device. They can show on its lock screen, so someone who sees it may learn that you use Calmquit.
9. Age, your account and other people
- You must be at least 18 years old to use Calmquit.
- An account is for one person, to stop nicotine themselves. Give a real email address, keep your sign-in details safe, and do not share your account. You are responsible for what happens in it.
- An account can be signed in on one device at a time. Signing in on a new device signs out the others.
- In your reasons, your journal or a chat with Noa, you may mention other people, such as a partner or a child. Share only what you need, and nothing they would not want kept.
10. The purchase
- Calmquit is a paid download. You buy it once, on the App Store or Google Play. Apple or Google sells it under their own terms and charges your Apple ID or Google account when you confirm the purchase.
- The price and any tax are shown in the store before you buy. Prices can differ between the App Store and Google Play, and between countries.
- The purchase includes every lesson, every tool and Noa. There is no subscription, nothing to buy inside the app and no ads.
- The purchase stays with the Apple ID or Google account that made it, under the store's rules. Your Calmquit account is separate: deleting it does not refund the purchase.
- Refunds follow Apple's and Google's rules: ask them. Withdrawals from a purchase made in the App Store or Google Play also go through their own processes.
- Noa answers only a genuine copy of Calmquit. On iPhone and iPad, Apple's App Attest checks that the app is ours. On Android, Google Play Integrity checks the app and the device, and that Google Play has licensed Calmquit to the Google account on the device. A copy from anywhere else, a rooted device or an emulator gets no replies from Noa.
11. Using Calmquit fairly
In general
You agree not to:
- Use Calmquit for anything illegal, or in a way that infringes other people's rights.
- Try to get around the limits, including Noa's daily limit, the one-device rule, the checks that a copy of Calmquit is genuine, or our security.
- Copy, decompile or reverse engineer Calmquit, except where the law allows it.
- Resell, rent or redistribute Calmquit or its course, scrape it, or use it to build a competing service.
- Overload Calmquit, or use bots or scripts to send messages.
When you talk to Noa
You agree not to:
- Share more about other people than you need (section 9), or pretend to be someone else.
- Rely on Noa in an emergency, or leave someone who may be in danger without calling for help (section 4).
- Present a reply as the advice of a doctor or another professional.
- Try to make Noa claim to be human or a professional, or to give doses or instructions for self-harm, or to break its rules in any other way.
- Use Noa to harm, harass or deceive anyone, or for sexual or romantic chat.
- Insult, threaten or abuse Noa, or send it content meant to break it.
You can report a reply that is wrong, unsafe or offensive from the reply itself. We read reported replies to check them and improve Noa's answers.
We may remove content or suspend an account that breaks these rules. We may report illegal content to the authorities.
12. Your content
"Your content" means what you enter and write in Calmquit: your quit plan and your reasons, your answers to the lessons' questions, your check-ins and journal, and your messages to Noa, with Noa's replies to you.
Your content stays yours. You give us a licence to store, process and show it, and to send it to the providers named in our privacy policy, only to provide Calmquit to you. This licence ends when you delete the content or your account. We do not use your content to train AI models.
13. Intellectual property
Ours
Calmquit, its name and logo, its design, its pictures, its course and its other texts, and its software belong to us or our licensors. The course is our own work. We give you a personal, limited, non-exclusive, non-transferable right to use Calmquit under these terms. We can take this right back if you break them.
Yours
You may keep, copy and share your own words and Noa's replies to you.
Copyright complaints
If you believe something in Calmquit infringes your copyright, write to support@calmquit.com or to Morlans, San Sebastián, Spain. Include: your contact details; the work you believe is infringed; where the content is in Calmquit; a statement that you believe in good faith that the use is not authorised; a statement, under penalty of perjury, that your notice is accurate and that you own the right or may act for its owner; and your physical or electronic signature. We may remove the content.
14. Other services and links
Calmquit links to services we do not run, such as the App Store, Google Play, the sign-in pages of Apple and Google, the websites of help lines and the sources of its health facts. Their own terms and privacy policies apply to them, and we are not responsible for them. When you copy a reply and share it, it leaves Calmquit, and whoever receives it handles it under their own rules.
15. Availability, changes and ending the agreement
- We may change, add or remove features or limits, Noa's daily limit included, or limit or stop Calmquit. If we take away something the purchase includes, we tell you first.
- Calmquit needs an internet connection to keep your plan and progress in your account and to talk to Noa, and Noa depends on AI models that other companies run. It can be slow or unavailable. Your mobile operator's data charges are yours.
- You can stop using Calmquit and delete your account at any time. See the account deletion page.
- We may suspend or close your account if you break these terms, if the law requires it, or if we stop offering Calmquit. If we close your account without a breach on your part, we tell you first when we can.
- The parts of these terms that by their nature should last, such as those on health decisions, intellectual property, liability and governing law, stay in force after the agreement ends.
16. No warranties
We provide Calmquit "as is" and "as available". We work to keep it running, safe and correct, but we do not promise that it will always be available, free of errors or secure, or that its lessons, replies, counters, health facts or help lines will be correct, complete or right for you. As far as the law allows, we give no other warranties, express or implied.
17. Limits of our liability
To the extent the law allows:
- We are not liable for decisions about your health made on the basis of Calmquit, including a decision about a medicine or to get care later or not at all, or for harm from a lesson, a reply, a counter, a health fact or a help line.
- We are not liable for indirect or consequential losses, lost profits or data.
- Our total liability to you is limited to the price you paid for Calmquit.
- You will compensate us for claims by others caused by your content or by your breach of these terms.
Nothing in these terms limits liability that the law does not allow us to limit, such as for death or personal injury caused by negligence, or for fraud. Nothing in these terms takes away rights you have as a consumer under the law where you live.
18. Following the law
You may not use Calmquit if you are in a country under a comprehensive embargo, or on a government list of people who may not receive services. You are responsible for following the laws that apply where you use Calmquit.
19. Governing law and disputes
These terms are governed by the laws of Spain. Disputes go to the courts of Spain.
If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you can also bring a claim in its courts. We would like to hear from you first: most problems are solved with an email.
20. Changes to these terms
We may update these terms. The date at the top shows the latest version. If a change matters to you, we tell you in the app or by email before it applies. If you keep using Calmquit after that, the new terms apply. If you do not accept them, stop using Calmquit and delete your account.
21. General
- If a court finds part of these terms invalid, the rest stays in force.
- You may not transfer your rights under these terms to anyone else. We may transfer ours to a company that takes over Calmquit, without reducing your rights.
- If we do not enforce a right at once, we do not give it up.
- These terms and the privacy policy are the whole agreement between you and us about Calmquit. Section 22 and the store's own terms also apply, and section 22 wins where it differs from the rest.
22. If you got Calmquit from the App Store or Google Play
App Store
If you downloaded Calmquit from Apple's App Store, these terms also include the following, which win over anything else in them:
- These terms are between you and us, not Apple. We, not Apple, are responsible for Calmquit and its content.
- Your right to use Calmquit is limited to Apple-branded devices that you own or control, as the Usage Rules in Apple's Media Services Terms and Conditions allow, including use by other accounts through Family Sharing where those rules allow it.
- We alone provide maintenance and support for Calmquit. Apple has no obligation to provide any maintenance or support for it.
- If Calmquit fails to meet a warranty that applies to it, you may tell Apple, and Apple will refund the purchase price for Calmquit. To the extent the law allows, Apple has no other warranty obligation for Calmquit. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty are our responsibility, as far as these terms and the law make them so.
- We, not Apple, are responsible for handling any claims by you or anyone else about Calmquit or your use of it, including product liability claims, claims that Calmquit fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If anyone claims that Calmquit or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not in a country that is subject to a United States Government embargo or that the United States Government has designated as a "terrorist supporting" country, and that you are not on any United States Government list of prohibited or restricted parties.
- When you use Calmquit, you must also follow the terms of third parties that apply to you, such as your mobile data provider's.
- Questions, complaints and claims about Calmquit go to us, not Apple: Lucero Studio, Morlans, San Sebastián, Spain, support@calmquit.com.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right, and is deemed to have accepted it, to enforce these terms against you as a third-party beneficiary.
Google Play
If you downloaded Calmquit from Google Play, Google Play's Terms of Service also apply to the download and the purchase. Google is not a party to these terms and is not responsible for Calmquit.
